What is it?

A Driveway Permit is formal approval from your local council to construct or modify a driveway or crossover — the part of your driveway that crosses public land to connect your property with the road.

Why is this needed?

A driveway permit is required because your driveway crosses council-owned land (like the footpath, kerb, or verge). Councils use the permit process to ensure the design meets local standards, protects public assets and utilities, and keeps road users and pedestrians safe. Without approval, you could face fines or be made to remove or rebuild the driveway.

How to do this task

  1. Look up your local council’s rules or use their online checklist to see if you need a permit.
  2. Provide a site plan showing the driveway location, size, and design (sometimes with photos or engineer drawings).
  3. Lodge your application online or at the council office and pay the fee.
  4. The council reviews your design to make sure it meets safety and design standards.
  5. If approved, you’ll receive a permit with conditions (e.g. construction standards, protection of assets).

Example: Permit with Brisbane City Council

1. Go to the Brisbane City Council’s page for residential driveway permits

2. Check your application type:

  • Self-Assessment Permit – meets all council rules (distances from trees, drains, bus stops, etc.)
  • Full Assessment Permit – if any rules are not met

3. Prepare your required documents (as stated on website)

4. Apply online:

  • Self-Assessment: $20.30, instant approval
  • Full Assessment: $293.40, ~20 working days

5. Build within 12 months according to permit conditions
