What is an Occupy Roadway Permit?

Why is this Needed?

Using or obstructing any public area requires formal approval to:

  • Ensure public safety is maintained
  • Prevent damage to council-owned assets (e.g. kerbs, pavements)
  • Help your project comply with local laws and traffic management requirements


Without this permit, you may face fines or be forced to stop work.

How it Works

1. Identify your local council

2. Access the permit page:

  • Go to your local council’s website
  • Search for: “Occupy Roadway Permit” (It may also appear as “Road Occupation Permit” or “Asset Protection Permit”)
  • Locate and open the application form or online portal

3. Complete the application form. You’ll typically need to provide:

  • Your contact details (as applicant)
  • Site address and details of the building works
  • Nature and duration of occupation (e.g. skip bin on footpath, crane on road)
  • A damage or condition report of surrounding council assets (if required)
  • Bond refund details (for when works are completed and site reinstated)

4. Submit your application:

  • Submit via your council’s online portal, or
  • Email the completed PDF form to the address listed

5. Pay the permit fee:

  • Fees range from $150–$400, depending on council and duration
  • Some councils may require a security bond

6. Await approval:

  • Most councils respond within 2–7 business days
  • Once approved, you’ll receive your permit via email
